Introduction

These Terms and Conditions ("Terms") govern your use of SMS (Short Message Service) communications provided by No Problem Atoll Technologies (NPAT), including NPAT Business Trust Company, NPAT.com, and affiliated services (collectively referred to as "NPAT," "we," "us," or "our"). By opting in to receive SMS communications from NPAT, you agree to comply with these Terms and Conditions, as well as any applicable local, state, or federal laws.



1. Acceptance of Terms

By consenting to receive SMS communications from NPAT, you agree to be bound by these Terms. If you do not agree with these Terms, you must opt-out from receiving any future communications by following the opt-out instructions in any message you receive from us.



2. Opt-In and Consent

Customers can call our phone number 727-595-5565, which they can get from referrals or our social media or website NPAT.com. They provide their consent to receive text messages from us by agreeing to the following script: ‘By providing your mobile number, you agree to receive text messages from No Problem Atoll Technologies (NPAT) regarding appointment reminders, updates, and responses to your inquiries. Message frequency varies based on communication needs. Message & data rates may apply. No mobile information will be shared with third parties. You can reply STOP to unsubscribe at any time or HELP for assistance.’

Alternatively, customers get our phone number from referrals, one of our social media profiles such as https://www.linkedin.com/company/no-problem-atoll-technologies or website https://NPAT.com. They can text START to 727-595-5565 to receive updates from No Problem Atoll Technologies (NPAT and they will receive the following message: ‘Thank you for opting in to receive recurring messages from No Problem Atoll Technologies (NPAT). Msg frequency varies. Msg & data rates may apply. No mobile information will be shared with third parties. Reply HELP for help. Reply STOP to cancel.’

By opting in to our SMS service, you explicitly consent to receive sales, marketing, and transactional messages from NPAT, including but not limited to promotions, service updates, appointment reminders, and other related messages. Standard messaging rates may apply as determined by your mobile carrier.  All traffic sent on behalf of NPAT must have prior opt-in/consent.  Prior opt-in/consent is required in order for customers to receive the above mentioned update message types. Opt-in must be on an individual level. NPAT cannot and will not share information with third parties. Permission cannot be taken as implied. Acceptable opt-ins methods may include, but are not limited to, online forms, paper forms, verbal opt-ins over the phone, or text messages.



3. SMS Registration Compliance

NPAT has registered its SMS campaigns and business information with The Campaign Registry to comply with the latest SMS compliance regulations set to take effect on December 1, 2024. This includes the use of verified, legitimate messaging practices and ensuring that all SMS campaigns are properly identified.



4. Opt-Out and Message Frequency

You may opt-out of receiving SMS communications at any time by replying “STOP” or "UNSUBSCRIBE" to any message you receive from us. Upon receipt of your "STOP" or "UNSUBSCRIBE" request, we will discontinue sending you SMS messages, unless otherwise required by law. You may also text “HELP” for assistance or to inquire about your subscription.

The frequency of SMS messages will vary based on the type of communication and your preferences. We will notify you of the frequency of messages when you opt-in.



5. Use of SMS Communications

You agree to use our SMS service solely for lawful purposes. You may not use our SMS service to transmit any harmful, abusive, or unlawful content, including spam, harassment, or threats. Any misuse of the service may result in suspension or termination of your participation.



6. Privacy and Data Protection

By agreeing to receive SMS communications, you consent to the collection, use, and storage of personal data related to your phone number, communication preferences, and engagement with our SMS campaigns. All data collection and handling practices are in compliance with our Privacy Policy, which is available on our website.

We do not share your phone number with third-party entities for their marketing purposes without your explicit consent. However, we may share your information with third-party service providers that assist in delivering our SMS services, under strict contractual obligations to protect your privacy.



7. Message Content

All messages sent from NPAT are intended for informational or marketing purposes related to our products and services. We aim to provide you with accurate and valuable information through SMS communications. However, we do not guarantee the accuracy, completeness, or timeliness of any message sent through SMS.



8. Fees and Charges

Message and data rates may apply when receiving SMS communications. You are responsible for any charges incurred through your mobile carrier for receiving these messages. NPAT is not responsible for any costs associated with your mobile service plan.



9. Limitation of Liability

NPAT, its affiliates, and its service providers are not responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our SMS service, including but not limited to damages caused by message delivery failures, delays, or errors.



10. Modifications to Service

NPAT reserves the right to modify, suspend, or discontinue the SMS service at any time, without prior notice, at its sole discretion. If any significant changes are made to the service, we will notify you as required by law.



11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law principles. Any disputes related to SMS communications will be resolved through binding arbitration in St. Petersburg, FL, in accordance with the rules of American Arbitration Association (ADR.org).



12. Compliance with Applicable Laws

NPAT's SMS services are designed to comply with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the Cellular Telephone Industries Association (CTIA) guidelines, and any applicable state and federal regulations. NPAT also adheres to the latest SMS compliance regulations, including those requiring registration with The Campaign Registry, effective December 1, 2024.
